1. About Us
Iron Field Equipment Supply, LLC is an independent US dealer of compact heavy equipment, attachments, and parts. We are not an authorized OEM dealer for the brands we carry; we sell equipment from a range of manufacturers and describe them as the brands we carry. Any brand names are used only to identify the products we offer.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to purchase from us. By ordering, you represent that the information you provide is accurate and that you are authorized to use the payment method you select.
3. Products, Pricing, and Availability
We work to describe and price products accurately, including condition (new, used, or refurbished). Occasional errors in pricing, specifications, images, or availability may occur.
If we discover an error affecting your order, such as a significant pricing mistake or an item that is no longer available, we will contact you to correct it, offer an alternative, or cancel the order and provide a full refund of anything paid.
Prices are shown in US dollars and do not include freight or applicable sales tax, which are calculated and confirmed before payment.
Product availability is not guaranteed until your order is accepted and payment is confirmed.
4. Orders and Acceptance
When you place an order, you are making an offer to purchase. Your order is confirmed but remains in pending status until payment is completed. We reserve the right to accept or decline any order, including for suspected fraud, pricing errors, stock issues, or shipping limitations. A contract of sale is formed only when we accept your order and confirm payment.
5. Payment
We accept payment by credit card and wire transfer, both handled after the order is placed:
Credit Card: we email you a secure payment link to pay by card. The order remains pending until payment completes.
Wire Transfer: we email you wire instructions. The order remains pending until funds clear.
We do not process live card payments at checkout and do not store full payment card or bank account details on the site. Orders are not shipped until payment is confirmed. See our Payment Policy for full details.
6. Shipping and Delivery
We arrange freight for machines and ship parts by standard carriers. Transit times are estimates, not guarantees. Risk of loss and title pass to you upon delivery. You are responsible for inspecting deliveries and noting any damage at the time of delivery. See our Shipping & Freight Policy and Returns & Refund Policy.
7. Returns, Refunds, and Warranty
Returns and refunds are governed by our Returns & Refund Policy. Warranty coverage is governed by our Warranty Policy. These policies are incorporated into these Terms by reference.
8. Use of the Website
You agree not to misuse the site, including by attempting to gain unauthorized access, interfering with its operation, scraping content, submitting false information, or using it for unlawful purposes. We may suspend or terminate access for violations.
9. Intellectual Property
The content on this site, including text, graphics, logos, and layout, is owned by or licensed to Iron Field and is protected by intellectual property laws. You may not copy, reproduce, or distribute it without permission, except for personal, non-commercial use related to your purchase.
10. Disclaimers
Except as expressly stated in our Warranty Policy and as required by law, products are provided “as described.” We disclaim, to the fullest extent permitted by law, implied warranties not expressly granted. You are responsible for operating equipment safely, following manufacturer instructions, and complying with all applicable laws and safety requirements.
11. Limitation of Liability
To the fullest extent permitted by law, Iron Field is not liable for indirect, incidental, special, or consequential damages arising from your use of the site or products, including lost profits, downtime, or property damage. Our total liability for any claim related to a purchase will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Iron Field and its owners and employees from claims, losses, and expenses arising from your breach of these Terms, your misuse of the site, or your operation of purchased equipment.
13. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute will be subject to the jurisdiction of the state and federal courts located in Missouri, unless otherwise required by applicable consumer law.
14. Changes to These Terms
We may update these Terms from time to time. The version posted at the time of your order governs that order. Continued use of the site after changes constitutes acceptance of the updated Terms.
